By accessing or using our products and services under any circumstance, you agree to and accept the terms of this agreement. 1. Use of the Service
1.1 Basic Terms
Regardless of whether you register for a Time Store account, these terms are effective when you use Time Store products. Using the products includes but is not limited to browsing, searching, posting, displaying, selling, or purchasing, and other actions. You can only use this product when you agree to be bound by Time Store under the protection of the law. If you are under the age of 10, you may not meet the conditions for using or accessing our product. If you accept this agreement, whether you represent yourself or another legal entity, this agreement becomes effective and legally binding on you and the legal entity you represent. Certain specific businesses or services may have additional terms, which will be applied when you use these businesses or services. When you access or start using these businesses or services, it means you agree to and comply with their terms.
1.2 Agreement and Account
Within the scope permitted by this agreement, we grant you a limited, non-exclusive, non-transferable right to use Time Store services. When you use certain services, you need to register a Time Store account to meet all the usage conditions. You need to provide as much detailed personal information as possible to us and ensure the timely update of this information. You cannot rent, sell, or transfer your account to any third-party individuals or organizations. You need to protect your password and keep other information about your username and password confidential. If you find any security vulnerabilities with your account or lose control of your account, please contact us promptly.
1.3 Privacy Terms
Please read our privacy terms carefully, which specify how we collect and use your information when you use our services. Our privacy terms are part of the overall user agreement. When you use our product services, you agree to our collection and use of your information within the scope of the user agreement and privacy terms.
2. Content and Ownership
The 'content' in this basic content clause includes all images, text, information, materials, audio-video image data, code, software, and other materials that constitute and maintain the operation of the service. The 'content' includes but is not limited to 'user-generated content.' In this agreement, 'user-generated content' refers to the content provided by users through our service, including but not limited to images, text, or other audio-video materials uploaded by item initiators, artists, collectors, celebrities, or other users. We do not assert ownership of 'user-generated content.' Under this agreement, each user retains ownership of their own content. Other content about user information will be explained in the remaining clauses.
2.1 Intellectual Property and Ownership
Ownership of all content belongs to Time Store or individuals or organizations that have granted us ownership. Ownership of these contents is protected by intellectual property laws, trademark laws, and other property rights laws in the People's Republic of China and globally. This service is also protected by intellectual property laws in the People's Republic of China. Between you and Time Store, Time Store owns and retains all rights, including the interface, design, layout, and other content provided to you in our services, such as copyrights, registered trademark rights, the right to protect trade secrets, patent rights, moral rights, data protection rights, and other intellectual property rights and ownership. Website trademarks, service marks, website logos, and website names displayed on our service are Time Store's trademarks in the People's Republic of China. When you use our product, it does not mean you have rights beyond those specified in this agreement, especially not rights to our copyrights, trademarks, or other intellectual property rights. In this agreement, we reserve the right to clearly grant you certain rights.
2.2 Use of User-Generated Content
You may submit user information to our service within the scope of this agreement. We will also provide some interactive features, including publicly posting works or articles and interacting with other users. The use of these contents still follows the current content and ownership terms, with no additional terms and conditions. If you are a teacher, you may provide us with some course lecture content or manuscripts, which have strict copyright and cannot be commercially copied, distributed, or published. Unless otherwise stated, without written consent from the copyright owner, you cannot copy, distribute, alter, modify, translate, make derivative works, and publish content with specific intellectual property rights.
2.3 Warning for Inappropriate Content
Please note that the content displayed on our website covers a wide range of artistic categories, and some content may not have been reviewed by us and may contain nudity or other content that may be deemed inappropriate for children to view. If you allow your child or other children under your supervision to access Time Store, it means you are aware of these issues and have a responsibility to prevent them from accessing specific content that you deem unsuitable for them.
3.User Content
3.1 User Conten
Our services may include features that allow you to submit, upload, or otherwise provide images, text, audio, video, and other materials. You are the most appropriate person to judge whether your user content can be disseminated through our services, and you are responsible for ensuring that your user content complies with existing laws and other ownership terms, including but not limited to property rights, privacy rights, and publicity rights. You agree that, including your own user content, all content on this site can be made public according to the privacy policy and user settings. We encourage you to provide positive feedback and suggestions on our products, and you agree that we can use your feedback or suggestions for free.
3.2 User Content Authorization
We will not require the copyright to your user content; you are still the intellectual property owner of your user content. When you submit, post, or provide your user content, you grant us a non-exclusive, free, global, perpetual, irrevocable, and sublicensable permission. This permission includes the use, reproduction, distribution, display, adaptation, modification, translation, creation of derivative works, public performance, and display of your user content for development, distribution, promotion, and other purposes in existing and future media. We ensure that you own and control your user content and are not subject to any individual or group infringement rights.
3.3 Review and Deletion Rights
We have no obligation, but we reserve the right to monitor or review content that is alleged to violate the agreement or other management terms at any time. We reserve the right to disclose user content or other information in certain specific situations according to our judgment and in accordance with applicable laws, regulations, judgments, or other government requirements. You agree that we have the right to remove or refuse to display such information unilaterally at any time without notifying you when we believe that certain information may violate this agreement, the law, or other third-party regulations. You agree that we are not responsible for any liability related to the reasonable use of your user content as required by the agreement.
3.4 No Additional Liability
Please note that we will not make any commitments, suggestions, or representations regarding the accuracy, completeness, and authenticity of your user information to other users or third parties. You agree that we have no obligation to review or preview content posted by other users before it is posted to the service. You may receive some content that is offensive, inaccurate, or misleading, and you agree that we are not responsible for the impact of content posted by other users on you.
4. Guiding Principles
4.1 Content Guidance Principles
All posted content must comply with the laws of the People's Republic of China or the user's country.
We advocate free creation, communication, and exchange within the boundaries of the law.
Works and expressions that promote discrimination or hatred based on race, nationality, ethnicity, religion, etc., will be removed.
Indecent content, personal attacks, intentional harassment, and other malicious or abusive works and expressions will be removed.
Works and expressions related to sensitive topics such as pornography, ideology, or other harmful content will be removed.
4.2 Image Guidance Principles
We encourage you to use Time Store's products and services freely, openly, and diversely based on your personal preferences.
Please do not upload photos or images that involve others' privacy, obscenity, violence, gore, or other content that violates national laws and regulations or may pose potential threats to the operation of Time Store.
Please take responsibility for the copyright of the works, photos, articles, or images you upload. Time Store is not responsible for any third-party liabilities and legal risks arising from this.
According to the guidance principles or based on complaints from users or other rightful owners, Time Store may delete the content you post and reserves the right to take further action on your account.
This principle applies to all images on the Time Store website, including but not limited to works images, cover images, avatars, article illustrations, etc. For more details, please refer to the user agreement and privacy policy.
4.3 User Management Principles
The content you post should comply with the user agreement, privacy policy, and guidance principles.
Time Store administrators have the right to delete any content that violates the user agreement, privacy policy, or guidance principles.
Users engaged in the following behaviors may have their permissions frozen: impersonating other users, abusing service resources, operating bots, excessive marketing, malicious attacks, or spamming advertisements.
In case of special circumstances or requests from relevant government agencies, Time Store reserves the right to directly deactivate or cancel accounts.
5. User Auction Services
User Rights and Obligations
Users should securely manage their usernames and passwords. Participating in the auction is considered an act of the user, and the user should bear the corresponding obligations and responsibilities resulting from auction activities.
The goods for auction are provided by the merchants, and the merchants are responsible for uploading product information, product descriptions, product delivery, and related after-sales services. Before participating in the auction, users should carefully review the information and descriptions of the auctioned items on the auction page and understand that variations may occur in the color tones and other aspects when compared to the original item due to photography, display, etc. The original item shall prevail.
Bidding: During the auction, when a user successfully places a bid, the bid amount is frozen. When someone places a higher bid, the previous bidder's capital is refunded, and the earnings are frozen. Earnings will be unlocked only after the execution is completed.
Transfer: After the auction ends, the winning bidder has the right to transfer the item. After the transfer is completed, the transfer amount is frozen, and the amount will be unlocked only after execution is completed.
Execution: When a user successfully obtains the final auctioned item, they should complete the auctioned item execution according to the auction rules. If the transaction is not completed according to the auction rules, the user should bear the corresponding responsibilities and adverse consequences as per the auction rules.
6. Disclaimer
We make every effort to ensure the operational status and availability of this service. You must agree that there are some risks inherent in using this service. To the fullest extent permitted within this agreement, we ensure that all services provided to you are reasonably reliable and accurate, including but not limited to warranties that are merchantable, of satisfactory quality, accurate, complete, timely, or reliable. We do not guarantee that all services are suitable for your specific requirements, accurate, error-free, secure, free from viruses, or other harmful components. We will not be responsible for the costs associated with service changes, equipment, or data maintenance or replacement for any reason other than those provided in a written agreement with Time Store. We are not responsible for any harm caused by advice or additional information from us or others (oral, written, or in print). Due to the laws of some jurisdictions not allowing the exclusion of implied warranties, some of the exclusion clauses in this section may not apply to you.
7. Release of Liability
Please note that despite the rules and terms in this agreement, there may still be individuals who gain unauthorized access to our service and engage in illegal, offensive, or harmful activities through deception or fraud. We are not responsible for any issues arising from such activities, whether online or offline, involving transactions or user content. Additionally, we disclaim any responsibility for the quality or availability of third-party services or any transactions involving property rights in third-party services. Each user is responsible for their communications, transactions, and other interactions with other users or third-party services.
To the maximum extent permitted by applicable law, Time Store and its employees, owners, board members, advisors, agents, or employees will not be liable for any claims or damages arising from the following, whether or not they are aware, whether intentional or not: (i) your compensation and disputes with other users; (ii) content from other users; (iii) any works or content provided or sold on third-party services; and/or (iv) any unauthorized third-party access to or use of our products and services, your account, and/or your user content.
8. Limited Liability
In no event will Time Store and its employees, owners, board members, advisors, agents, or employees be liable for indirect, incidental, punitive, specific, or damages related to profits, revenue, data, use, reputation, or other intangible assets connected with (i) the inability to use the service; (ii) operations on third-party services on our platform; and/or (iii) under any circumstances, if, for any reason, Time Store, its employees, owners, board members, advisors, agents, or other employees, is required to pay more than CNY 1,000 in compensation, we have three months to decide whether to compensate.
In this section, the limited liability applies to all claims, regardless of whether they are based on agreement, contract, tort (including negligence), strict liability, or any other legal matter. Whether or not we have been informed of the possibility of such damages, even if certain clauses in this agreement have lost their original purpose since the time of drafting. In certain jurisdictions, because indirect or consequential damages are not recognized, some of the exclusion clauses in this section may not apply to you.
9. Indemnity
You agree to indemnify and defend Time Store and its management, directors, agents, and other employees from all losses incurred due to third parties and your negligence. This includes your user information, any false content generated by you, or any other actions that violate the law or third-party agreements. These losses include litigation or liability resulting from damage, loss, and expenses (including attorney's fees). We reserve the right to defend, and at the same time, you must provide as much support as possible. This obligation for indemnification and defense will continue to apply during your use in accordance with this agreement.
10. International Use
Time Store is established under the laws of the People's Republic of China, Hong Kong, and we cannot fully guarantee or warrant that our services can still be used in countries or regions outside Hong Kong, China. If you use Time Store in other countries or regions, please adhere to the local laws, regulations, and rules of your country.
11. Service Changes
Our services will undergo changes from time to time, and our features may also change without notifying you. We reserve the right to change, update, add, delete, or suspend (part of) service features unilaterally, including but not limited to service interface, design, product features. We may make service changes unilaterally at any time: all or part, temporarily or permanently, with or without notice. We are not responsible for the impact on third parties caused by service changes.
12. Agreement Changes
We reserve the right to unilaterally change this agreement under any circumstances, including changing, adding, or deleting any terms in this agreement. Unless changes are made due to regulatory or legal reasons, we will provide a 14-day notice period for updating the terms before the formal change. You agree that we can inform you of changes to the terms by updating this terms page, and you need to periodically check this page to keep track of the latest changes. The updated content of this agreement will be posted on the website or incorporated into subsequent versions of the agreement. If you continue to use our products after the agreement changes, it means you accept the changes to the agreement. Agreement changes do not apply to claims or disputes arising before the changes, and all claims and disputes are subject to the agreement version in effect at the time.
13. Suspension
You can stop using our services at any time. When you violate this agreement, you agree that we can unilaterally suspend this agreement at any time, restrict, suspend, or stop your access to this service, or withdraw your username without assuming any notice or other liabilities. When you suspend the agreement or stop using our products, the following content will remain fully effective and have enforceable conditions: (i) your outstanding debts to us, including debt payment; (ii) all measures that can remedy this agreement, and (iii) the following sections of this agreement: 2 Content and Ownership, 3 User Content, 7 Other Websites and Services, 8 Disclaimer, 9 Liability Contacts, 10 Limited Liability, 11 Indemnity, 15 Suspension, 16 All Terms, 17 Others.
14. All Terms
This agreement, including our privacy terms, other terms (including written agreements) incorporated into this agreement, and our sales agreement, constitutes all the agreements and consensus between you and Time Store. These contents will replace all other written, oral, or electronic agreements you made with us before. You and we agree that if any term of this agreement is deemed invalid by a court of competent jurisdiction or for any other reason, that term will be enforced to the maximum extent permitted by law, and all other terms of this agreement will remain in effect.
15. Other
Our delay or failure to enforce certain terms or provisions of this agreement does not constitute a waiver of our rights granted by this agreement. Unless we provide a formal written statement, we do not waive any rights granted in this agreement or subsequent actions. This agreement can be used as part of inheritance or assignment, but these rights will only be effective after you obtain our written authorization. The content and our rights in this agreement will be inherited directly by our successors or assignees unless otherwise stated. This agreement only applies to Time Store and you, with no other third-party binding force. There is no agency, partnership, joint venture, employment, or dealership relationship between the parties in this agreement, and they are not bound by this agreement. This agreement is written in Simplified Chinese, and any possible ambiguity or conflict caused by translation is subject to the Simplified Chinese version of this agreement.
16. Copyright Statement
User-created original work sets and work images, original articles, updates, exhibition information, personal and institutional profiles, comments on user content, and other content on Time Store are owned by the users themselves.
If users obtain others' content from Time Store or other websites through methods such as reprints, copies, screenshots, etc., including but not limited to the original work sets and work images, original articles, exhibitions, profiles, comments, etc., the copyright of the relevant content belongs to the original author. Users may not infringe on others' intellectual property rights, including copyrights and other rights. If users' posting of others' works causes intellectual property or other legal disputes, users shall bear all consequences on their own, unrelated to Time Store.
The network services provided by Time Store, including logos, layout design, layout method, text, images, graphics, etc., are protected by copyright, trademarks, and other legal protections. The above-mentioned content may not be directly or indirectly published, used, rewritten for publication or use purposes, or used for any other commercial purposes on any platform without the consent of the relevant rights holders (including Time Store and other original rights holders).
Time Store has the right but not the obligation to review the content posted by users and has the right to deal with infringing information based on relevant evidence and in accordance with the 'Tort Liability Law,' 'Regulations on the Protection of Information Network Transmission Rights,' and other laws and regulations as well as Time Store guidelines.
Time Store respects the intellectual property rights and legitimate rights and interests of rights holders. If a rights holder believes that content uploaded by Time Store users infringes their copyright or other legitimate rights and interests, they can send a written application to the Time Store help mailbox. After Time Store has reviewed the complete materials in writing, it has the right to delete the relevant content without notifying the relevant publishing users and to keep the relevant data in accordance with the law. Posting content on Time Store is deemed to mean that the user agrees to the measures taken by.
If Time Store deletes relevant content due to the reasons mentioned above and the relevant user believes the complaint is unfounded, they can submit a written counter-complaint to Time Store's help email in accordance with the law. After receiving complete materials, we will handle the situation based on the actual circumstances.
